2. The petitioner seeks bail in connection with POCSO Case No. 35 of 2023 arising out of Sour Bazar P.S. Case No. 109 of 2023 registered for the offence under Sections 363, 365, 366(A), 120(B) of the Indian Penal Code and later on added Section 12 of the POCSO Act.

3. As per the prosecution case, the petitioner is accused of kidnapping the victim girl. In the statement made under Section 164 of the Cr.P.C. the victim girl has said that she had eloped with the petitioner.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 22.03.2023.

5. Considering the period of custody, this application for regular bail is allowed.

6. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-VI-cum-Special Judge, POCSO, Saharsa in connection with POCSO Case No. 35 of 2023 arising out of Sour Bazar P.S.
