JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-10-2016 Heard learned counsels for the petitioners and the State. The petitioners being the parents of the husband of the complainant are apprehending arrest in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Section 498A of the Indian Penal Code.
The basic accusation is of torture.
It is submitted by the learned counsel for the petitioners that the petitioners admit marriage of their son with the complainant and birth of twin children. The accusation against the petitioners is omnibus and general. Thrust of accusation is against the husband of the complainant and on readiness of the husband of the complainant that he is ready to keep the complainant as wife
Patna High Court Cr.Misc. No.47424 of 2016 (2) dt.28-10-2016 2/2 with full dignity and honour, he has been granted provisional anticipatory bail vide Cr. Misc. No. 46995 of 2016. Considering the thrust of accusation against the husband of the complainant, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-III, Munger in connection with Complaint Case No. 552 of 2016, subject to the conditions as laid down under Section 438(2) Cr.P.C.
