JUSTICE VINOD KUMAR SINHA ORAL ORDER 21-12-2016 Heard learned counsel for the petitioner as well as learned A.P.P. for the State.

The application is for grant of anticipatory bail for the offence under Sections 406, 420 and 34 of the Indian Penal Code. The allegation against the petitioner is that he along with other co-ccused persons had taken money from the informant on the ground of getting his son engaged in some government job. It is submitted on behalf of the petitioner that the petitioner is not concerned with the matter rather it is Ashok Kumar, against him there is allegation of taking money and he has already been granted bail by the court below. Heard learned A.P.P. also.

Having heard both sides. I am not inclined to grant

Patna High Court Cr.Misc. No.49284 of 2016 (2) dt.21-12-2016 2/2 anticipatory bail to the petitioner, accordingly, the same is rejected. However, considering the fact that other co-accused has already been granted bail by the learned court below itself, let the petitioner surrender before the court below and the court below will consider this aspect of the matter that the co-accused, against him there is allegation of taking money, has already been granted bail, shall dispose of the application without being prejudiced of the rejection by this Court.
