The petitioner apprehends his arrest in connection with Ujiyarpur P.S. Case No. 234 of 2017, registered under Section 307 and other allied Sections of the Indian Penal Code. The accusation is of making obstruction by 16 persons named in the F.I.R. including the petitioner in discharge of official duty by court Nazir in course of execution of decree for partition.
Learned counsel for the petitioner submits that while the petitioner is named in the F.I.R. but no specific overt act has been attributed against him. It is further submitted that co-accused, Md. Umar and others have already been granted
Patna High Court CR. MISC. No.59320 of 2019(2) dt.20-09-2019 2/2 privilege of pre-arrest bail by a Bench this Court vide order dated 06.03.2019 passed in Criminal Misc. No. 13804 of 2019. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dalsinghsarai, Samastipur, in connection with Ujiyarpur P.S. Case No. 234 of 2017, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
