Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioners seek bail in a case registered for the offences punishable under Sections 379, 341, 323, 504, 506, 308/34, 325 and 307 of the Indian Penal Code. Learned counsel for the petitioners submits that the petitioners are in custody since 13.08.2021, are persons with clean antecedent and charge-sheet has been submitted. The informant alleges that the petitioners came and assaulted the informant by fists and slaps and by iron rod causing injury to him and also assaulted to Rajesh Kumar and
Patna High Court CR. MISC. No.68916 of 2021(3) dt.11-04-2022 2/3 Prem Chand Kumar by bricks and stone causing injury to them and Ranvir Kumar snatched golden chain and Bittu Kumar took away Rs.5,000/-.
Leaned counsel for the petitioner submits that no doubt the injuries sustained by the informant is grievous in nature but the allegation of assault against the petitioners is general and omnibus in nature. Learned counsel for the petitioners submits that petitioner no. 1 is an old man and he is in jail custody as would be evident from Annexure-2 series to the supplementary affidavit. Relevant would be at para 9 wherein the Jail Doctor has written to the Jail Superintendent with regard to the precarious condition of petitioner no. 1. Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioners.
Considering the fact that the petitioners are in custody since 13.08.2021, are persons with clean antecedent and chargesheet has been submitted and the allegations against the petitioners are general and omnibus in nature, the petitioners, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending in connection with
