JUSTICE ARUN KUMAR ORAL ORDER 10-02-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with Buxar(T) P.S. Case No. 331 of 2016 registered under sections 406, 420, 467, 468, 471 and 472 of the Indian Penal Code. The allegation as per the informant is that she agreed to sell her Scorpio vehicle to the petitioner on the condition that he will deposit EMI to the Bank. The total money to be paid to the bank was to the tune of Rs. 10,74,164.00 and she signed some documents in connection with transferring the registration certificate of the vehicle in the name of the petitioner but only three months' EMI was paid by the petitioner and thereafter the petitioner stopped paying EMI.

It is submitted that in fact this petitioner paid Rs.

Patna High Court Cr.Misc. No.48590 of 2016 (4) dt.10-02-2017 12,00,000/- as consideration money in cash and the bank granted no dues certificate and thereafter registration was also transferred in the name of the petitioner, a copy of registration certificate has also been filed.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the court concerned, let the petitioner, namely, Himanshu Ranjan Choubey @ Sonu Choubey be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P.S. Case No. 331 of 2016, subject to the conditions as laid down under section 438(2) of the Cr.P.C.
