The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471, 472 and 406/34 of the Indian Penal Code. It is alleged that one Dharmendra Kumar was apprehended near a ATM Kiosk when four ATM cards and several mobiles were recovered. The apprehended accused Dharmendra Kumar disclosed the name of certain persons including petitioner who used to commit the offence of cash withdrawal through ATM.

It is submitted by learned counsel for the petitioner that the whole accusation is based on suspicion and there is no recovery from the petitioner. A statement has been

Patna High Court Cr.Misc. No.41798 of 2015 (2) dt.09-10-2015 2/2 made in paragraph 3 of the petition that the petitioner has no criminal antecedent and similarly situated co-accused Mithun Kumar has been granted anticipatory bail vide Cr. Misc. No. 32277 of 2015.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada in connection with Warsaliganj P.S. Case No. 128 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
