JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The victim stated in her statement recorded under section 164 of the Cr.P.C that she was kidnapped and raped by the petitioner but at the time of hearing of anticipatory bail petition no.4169 of 2016 filed on behalf of Nandlal Choudhary, the victim appeared before the Session Judge, Patna and disclosed that she had made statement under section 164 of the Cr.P.C on the pressure of her parents and, as a matter of fact, she voluntarily eloped with the petitioner and solemnized her marriage. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named,

Patna High Court Cr.Misc. No.47324 of 2016 (2) dt.09-12-2016 2/2 be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Barh, Patna in connection with Sammyagarh O.P.under Ghoswari P.S.Case No. 19 of 2016.
