In this case, the petitioner is apprehending his arrest in connection with Motipur P.S. Case No. 301 of 2016 registered for offences under sections 323, 341, 504, 353, 379 and 307 of the Indian Penal Code.

As per allegation, the Informant was going to attend his duty at Motipur police station. In the way, at the Darwaja of Tufani Paswan, Raju Paswan @ Rajiv and Upendra Kumar were quarreling for mobile. The Informant tried to pacify the matter upon which Raju Paswan @ Rajiv Kumar, Sonu Paswan, Pramod Paswan and the petitioner came with Lathi Danda, they surrounded him and stated assaulting and abusing the Informant.

Patna High Court Cr.Misc. No.33577 of 2017 (2) dt.24-07-2017 The petitioner has a criminal antecedent.

Looking to the entire facts and circumstances of the case as also the petitioner having criminal antecedent, this Court is not inclined to grant privilege of anticipatory bail to the petitioner. Accordingly, the prayer for anticipatory bail of the petitioner, namely, Tufani Paswan is rejected. If the petitioner surrenders before the court below within a period of four weeks from today and prays for bail, the court below will consider the same and will pass orders on the same day of appearance in accordance with law without being prejudiced by this order.
