JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-09-2015 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is in custody in a case registered under Sections 25(1-b)A, 26 and 35 of the Arms Act. The petitioner was neither apprehended at the spot nor anything has been recovered from the conscious possession of the petitioner. The name of the petitioner has surfaced on the confessional statement of co-accused, who were apprehended by the police at the spot.

The contention on behalf of the petitioner is that the petitioner was remanded in two other cases after the petitioner was made accused in the present case.

Considering the facts and circumstances of the case and

Patna High Court Cr.Misc. No.42196 of 2015 (2) dt.15-09-2015 2/2 also submission of learned counsel for the petitioner , let above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nawadah in Warsaliganj P.S.Case no. 47 of 2015.
