The petitioner seeks bail in connection with Raghunathpur P.S. Case No. 26 of 2021 instituted for the offences under Section 30(a) of the Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 25.08.2021, charge-sheet has been submitted in the case and has antecedent of five cases. Learned counsel for the petitioner submits that the allegation is of recovery of 80 litres of liquor from a bush. Learned counsel for the petitioner submits that the petitioner was not arrested from the spot rather he is alleged to have been identified by the villagers who were on inimical

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody since 25.08.2021, charge-sheet has been submitted in the case, was not arrested from the spot and his name came based on identification made by the villagers, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd-cum-Special Judge, Excise, Siwan in connection with Raghunathpur P.S. Case No. 26 of 2021 with a condition that one of the bailors shall be the father of the petitioner (Hareram Yadav) and further, if the petitioner is implicated in a case of similar nature, the court below shall forthwith cancel his bail bonds.
