JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 16-12-2019 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Complaint Case No. 1032C/2018 registered for the offences under Section 498A of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.
Learned counsel for the petitioners submits that this Court had issued notice to the complainant/opposite party no. 2 vide order dated 28.08.2019 and the interim order was passed. From the order sheet dated 08.11.2019 it appears that the notice was delivered to the opposite party no. 2. Learned counsel for the petitioner draws attention to
Patna High Court CR. MISC. No.53990 of 2019(6) dt.16-12-2019 2/2 paragraph 11 of the petition which reads as under: "That the petitioner is ready to keep his wife with honour and dignity and leading conjugal life happily."
Considering the fact that the petitioner has no criminal antecedent, this Court is inclined to grant bail to him. Let the petitioner, above-named, in the event of arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Araria in connection with Complaint Case No. 1032C/2018, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
