The petitioner apprehends his arrest in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 271 of 2018, registered under Sections 366(A)/34 and 376 of the Indian Penal Code and Section 4 of the POCSO Act.

The accusation is of kidnapping the daughter of the informant by Pankaj Kumar Yadav @ Khatai with the help of his family members and other co-villagers.

Learned counsel for the petitioner submits that, in fact, due to love affairs in between daughter of the informant and Pankaj Kumar Yadav, daughter of the informant left her parental house and perform the marriage with Pankaj Kumar

Patna High Court CR. MISC. No.56748 of 2019(2) dt.06-09-2019 2/2 Yadav at Deokuli Temple according to her own sweet will, which would appear from Annexure 2 to the application but with ulterior motive, the petitioner, who is co-villager of the informant, has falsely been implicated in this case with false allegation.

Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-I-cum-Special Judge, Buxar, in connection with Dumraon (Naya Bhojpur O.P.) P.S. Case No. 271 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
