The petitioners apprehend their arrest in Masaurhi P.S. Case No. 46 of 2017 registered for the offence punishable under Section 414 of the Indian Penal Code.

The informant alleged that while he was on patrolling duty seven persons on three motorcycles came but after seeing the police they started fleeing away. One person was apprehended who disclosed his name as Rajesh Kumar @ Golu and from his possession one motorcycle, two SIM cards etc. were recovered. The apprehended accused disclosed the name of the petitioner and stated that the petitioner and others committed theft in a cabin. Learned counsel for the petitioners submits that the petitioners were not apprehended on the spot. There is nothing on

Patna High Court Cr.Misc. No.18177 of 2017 (3) dt.13-07-2017 2/2 record to show that the petitioners committed theft of any article in the cabin. The petitioners have got no criminal antecedent. Considering the facts aforesaid the petitioners above named in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Masaurhi in Masaurhi P.S. Case No. 46 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
