====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ------------------ 15-10-2015 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Madhepura (Bharrahi) P.S. Case No.375 of 2015, corresponding to G.R. No.999 of 2015, registered under Sections 324, 323, 376, 511, 504 and 506 of the Indian Penal Code.

The accusation is that the petitioner entered into the house of the complainant/informant, Sanjira Khatoon, and made attempt to commit rape upon her minor daughter, Meshar Khatoon. Learned counsel appearing on behalf of the petitioner submits that in fact, the complainant/informant and her husband had taken Rs.20,000/- for the purpose of marriage of their

No.43462 of 2015 (2) dt.15-10-2015 2/2 daughter from the petitioner but they were not ready to return the said money to the petitioner in spite of Punchayati held on 18.05.2015. Thereafter, the petitioner filed Complaint Case No.297 of 2015 against the informant, her husband and other family members in the court of the Chief Judicial Magistrate, Madhepura, on 22.05.2015 and due to that reason, the informant only to put undue pressure upon the petitioner has lodged this false complaint case on 08.06.2015, after 20 days of the alleged occurrence, which is the basis of the F.I.R.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the C.J.M., Madhepura, in connection with Madhepura (Bharrahi) P.S. Case No.375 of 2015, corresponding to G.R. No.999 of 2015, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
