Petitioners apprehend their arrest in connection with a case registered under Sections 323, 354 and 380 of the Indian Penal Code.
Allegation in brief is that the petitioners after entering into the house of the complainant abused and outraged modesty of the complainant and committed theft.
Submission is that there was some dispute regarding passing of the tractor from the field during agricultural operation and for that earlier similar nature of case was lodged by the
Patna High Court Cr.Misc. No.28816 of 2017 (2) dt.13-07-2017 2/2 husband of the complainant for the same day of the occurrence but police registered the case in bailable section and therefore next day this complaint case was filed making false allegation of outraging the modesty. Except the case lodged by the husband of the complainant there is no other criminal antecedent. Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioners, namely, Pradeep Yadav and Jagdish Yadav be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Sub Judsge IV-Cum-A.C.J.M., Barh, Patna in connection with Complaint Case No.193(c) of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
