ANJANA MISHRA ORAL ORDER 04-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 17.07.2019 in connection with Excise Case No.617 of 2017 arising out of Sheikhpura (Hathiyawan) P.S. Case No.303 of 2017 registered for the offence under Sections 272, 273, 353 of the I.P.C. and Sections 30(a) of the Bihar Prohibition and Excise Act. Learned counsel for the petitioner submits that the alleged recoveries of country made liquor were made from the motorcycle which was standing on the wayside and not from the conscious possession of the petitioner. It is further submitted that the petitioner is accused in one another case, in which he has been granted bail.

Considering the aforementioned facts and

No.55191 of 2019(2) dt.04-09-2019 2/2 circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned ADJ 2nd Sheikhpura, in connection with Excise Case No.617 of 2017 arising out of Sheikhpura (Hathiyawan) P.S. Case No.303 of 2017.
