The petitioner has prayed for bail in connection with Paroo instituted for the offence under Section 302 read with 34 of the Indian Penal Code, 1860, Section 27 of the Arms Act. As per allegation in the FIR, informant alleged that on 24.04.2022 some outsiders came in a blue car at the doorstep of one Mahendra Das and started fighting. During the course of which petitioner started firing and at that point of time, the informant's nephew namely Krishna Kumar who was returning home from his tuition classes, got injured by gunshot injury. After that, the injured nephew was taken to hospital but he was refereed to PMCH, where he was declared dead.

It is further submitted vide para 7 of the petition that the entire dispute was between Mahendra Das and other persons during which the informant came at the place of occurrence and demanded an extortion of Rs. 1 lac from Mahendra Das, there is no motive or intention for the petitioner to get embroiled in the dispute rather he has falsely been implicated in this case. The petitioner is languishing in judicial custody since 04.07.2022. Learned APP appearing for the state has opposed the prayer of regular bail and submitted that there is direct allegation against the petitioner of shot fire upon the nephew of the informant due to which he shot dead. From perusal of case diary as well as post-mortem report, the cause of death of the deceased is haemorrhage and shock due to single firearm injury, which also corroborates the prosecution version. It is further submitted that the petitioner has got two criminal antecedents.
Having heard the learned counsel for the parties and considering the fact that there is direct allegation against the petitioner, this court is not inclined to enlarge the petitioner on bail and, as such, his prayer for bail stands rejected.
