Petitioner apprehends his arrest in Sheohar Mahila P.S. Case No.11 of 2015 instituted for the offence under Section(s) 354-A, 354-B, 447, 504, 506 Indian Penal Code and Section 8 of the POCSO Act pending in the Court of 1st Additional Sessions Judge-cum-Special Judge, POCSO, Sheohar. There is allegation in the written report that while the Informant/victim was returning from the river this petitioner misbehaved with her and also removed her clothes, pushed her down on the ground and attempted to commit illegal act. Case diary has been received. Statement of the victim recorded under Section 164 Cr. P.C. is available at para 5 of the case diary, wherein, she has leveled specific allegation
Patna High Court Cr.Misc. No.38947 of 2017 (3) dt.30-08-2017 2/2 against the petitioner of committing illegal act with her and also misbehaving at the bank of river.
In such circumstances, this Court does not find it a fit case for grant of anticipatory bail.
Prayer of the petitioner for grant of anticipatory bail is rejected.
Petitioner may surrender before the Court below and seek regular bail, which shall be considered and disposed off by the Court below in accordance with law without being prejudiced by this order.
