JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 05-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner apprehends his arrest in connection with Kiul P.S. Case No. 45/2019 registered for the offences punishable under Sections 337, 338, 332, 333, 353, 307, 379 411/34 of the Indian Penal Code, Sections 4/40 of Bihar Minor Mining Concession Act and Section 4/6/8 of the Bihar Control of Prevention of Illegal mining and Transportation and Storage Rules, under Section 15 of Environment Act(Pro) Act. Petitioner happens to be the owner of one of the seized tractors and, moreover, having more or less similar allegation, several co-accused have already been granted privilege of anticipatory bail by a co-ordinate Bench of this

Accordingly, it is ordered that petitioner, in the event of his arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai/concerned court in Kiul P.S.Case No. 45/2019 subject to conditions as laid down under Section 438(2) of the Cr.P.C.
