2. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 103(1), 61(2) (a) and 3(5) of the Bharatiya Nyaya Sanhita, 2023 .
3. The prosecution case, in brief, is that the informant, Khusbu Kumari, alleged that on 18.03.2025, she came to know that her brother had gone missing on 17.03.2025. During course of search, his corpse was discovered inside a well. Upon extrication of the body, it was identified as that of the brother of informant, riddled with gunshot injuries.
4. Learned counsel for the petitioner submitted that
Patna High Court CR. MISC. No.60226 of 2025(3) dt.21-11-2025 2/2 petitioner is not named in the F.I.R. During course of investigation , police approached petitioner to give statement as a witness and upon denial, he was falsely implicated in this case by police official. The only material that has come against this petitioner is that tower location of his mobile was found near the place of occurrence . Petitioner also resides in the same locality . Except this, there is no other material is available on record to suggest his involvement in the alleged occurrence . Petitioner is in custody since 22.03.2025. Charge-sheet has already been submitted.
5. Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, period of custody and other circumstances of the case, the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bihar Sharif Nalanda in connection with Rajgir P. S. Case No. 151 of 2025.
