Learned counsel for the petitioners is permitted to remove defect(s), as pointed out by the office, if any, within a period of four weeks from today.
Learned counsel for the petitioner seeks permission to withdraw the bail application of petitioner no.2, namely, Arvind Kumar @ Arbind Kumar @ Arvind Sah.
Permission is accorded.
Accordingly, the bail application of petitioner no.2, namely, Arvind Kumar @ Arbind Kumar @ Arvind Sah is dismissed as withdrawn.
Patna High Court CR. MISC. No.68669 of 2021(2) dt.08-03-2022 2/2 So far as petitioner no.1 Yogi Sah is concerned, he apprehends his arrest in connection with Palanwa P.S. Case No. 95 of 2021 for the offences under Sections 147, 148, 149, 341, 323, 302, 504 of the Indian Penal Code.
Considering the fact that there is specific allegation of assault against accused Rajeshwar Sah and petitioner no.1 (Yogi Sah) is his father and also considering his age, this application is allowed.
Let, petitioner no.1 Yogi Sah, in the event of arrest or surrender before the court below within one month from today, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Raxaul at East Champaran, Motihari in connection with Palanwa P.S.
