The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 366A and 376/34 of the Indian Penal Code.
The prosecution case is that the informant while going to Madhopur market was kidnapped by the petitioner and others when the petitioner took her to Gujrat and ravished her.
It is submitted by learned counsel for the petitioner that during medical examination the informant has been found aged about 17-18 years. The father of the informant
Patna High Court Cr.Misc. No.41792 of 2015 (2) dt.09-10-2015 2/2 lodged a Sanaha before Nagar Nausa police station on 07.06.2013 where he stated that on 30.05.2013 the informant went to Madhopur market but she did not return whereas another Sanaha was lodged on 08.06.2013 to the effect that the informant has returned on 08.06.2013 when no accusation has been levelled against the petitioner and for the occurrence of 30.05.2013 the present case was lodged on 10.06.2013. Prima facie from the document on record it appears that the informant went in the company of the petitioner of her own. Considering the fact that informant has been found approaching majority during medical examination, it is a case for consideration of prayer for regular bail, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Nagar Nausa P.S. Case No. 54 of 2013 pending in the court of learned Additional Chief Judicial Magistrate, Hilsa, Nalanda. With the aforesaid observation, this application is disposed of.
