JUSTICE ARUN KUMAR ORAL ORDER 10-08-2017 Heard learned counsel for the petitioner and the State. Petitioner apprehends his arrest in connection with a case registered under Section 304 of the Indian Penal Code. Allegation in brief is that the petitioner along with others had gone to swim in river with the help of the tube. The allegation is that others jumped off the tube and swam across the river whereas the informant's son was not knowing swimming get drowned and died.

It is submitted that all accused were swimming along with informant's son but he died in the river by drowning and this petitioner has no role in the alleged occurrence. It was accidental death.

Having considered the said facts and circumstances, in the event of arrest/surrender within four weeks from the date of

Patna High Court Cr.Misc. No.37406 of 2017 (2) dt.10-08-2017 2/2 receipt of this order to the concerned court, let the petitioner, namely, Parwej Alam @ Parwej be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M. Vth, Saran at Chapra in connection with Garkha P.S. Case No.264 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
