Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual mode.

The petitioner seeks regular bail in connection with Begusarai Muffashil P.S. Case No. 432 of 2022, lodged under Sections 120B of Indian Penal Code read with Sections 30(a) of the Bihar Prohibition and Excise Act, 2018.

As per prosecution case, the total recovery of 918 liter of foreign liquor has been made from a vehicle, which is subject matter of the present case.

Learned counsel for the petitioner submits that antecedent of the petitioner is clean and, petitioner is in custody

Patna High Court CR. MISC. No.56847 of 2022(2) dt.02-12-2022 2/2 since 19.08.2022. Learned counsel also submits that petitioner is alleged to be the driver of the said vehicle and he was completely unaware of what were loaded in the said vehicle. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Excise Judge-1st, Begusarai in connection with Begusarai Muffasil P.S. Case No. 432 of 2022, subject to the conditions as laid down under Section 437(3) of Cr.P.C.

With this observation, the bail application stands allowed.
