The petitioner being the Ex-Mukhiya of Kunjauri Panchayat in the District of Madhepura has prayed for grant of anticipatory bail in connection with Alamnagar P.S. case no. 94 of 2016, registered under Sections 420, 406, 409 /34 of the IPC lodged by the Block Development Officer with an allegation that under six Government Schemes, the petitioner was advanced certain Government funds but the work thereagainst was not completed. This Mukhiya as well as the Panchayat Secretary were made accuseds. Referring to Annexure-2, which is again a communication dated 13.08.2016, issued by the same informant and addressed to the Sub Inspector of Police, Alamnagar, it has been submitted upon verification those works were found to have

been completed as per the advance made thereagainst. Seen thus, in my view, the petitioner deserves the anticipatory bail.

In the facts and circumstances of the case, this Court is inclined to extend the privilege of anticipatory bail to the petitioner. Let the petitioner, named above, in the event of her arrest/surrender before the learned Court below within a period of four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Udakishunganj, Dist. Madhepura in connection with Alamnagar P.S. Case No. 94 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. with the further following conditions:- (i) One of the bailors shall be the own/close family member of the petitioner.

(ii) As soon as the charges are framed the petitioner shall appear in person before the trial Court on the date(s) fixed at the trial. In case of default in such appearance on two consecutive

dates, the trial Court shall have liberty to cancel the bail bonds of the petitioner and secure her arrest in accordance with law.
