2. The petitioner seeks bail in a case registered for offence under Sections 341, 323, 435, 436, 504, 447/34 of the Indian Penal Code.
3. As per F.I.R., on 27.01.2024 at about 02:00 Ρ.Μ., due to some altercation, this petitioner threatened informant that he would set the house of informant on fire and thereafter, all accused persons including this petitioner set the motorcycle of informant on fire, which was kept in the hutment, on account of which, informant suffered a loss of Rs. 7,00,000/-.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case due to enmity over panchayat election. There is general and omnibus
Patna High Court CR. MISC. No.60913 of 2024(3) dt.06-12-2024 2/2 allegation. Similarly situated co-accused Chandan Sahani has been granted anticipatory bail by this Court, vide order dated 16.07.2024 passed in Cr.Misc. No. 41881 of 2024. Petitioner is in custody since 13.04.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Motihari, East Champaran in connection with Chiraiya P.S. Case No. 33 of 2024.
