2. The accused/petitioner seeks bail in connection with Krishnapuri P.S. Case No. 122 of 2025 registered for the offences under Sections 25(1-b)a, 26 & 35 of the Arms Act.
3. The accused/petitioner is named in the First Information Report and is in custody since 12.05.2025.
4. As per FIR, petitioner along with other co-accused persons were apprehended by police, who were trying to flee away with Scorpio vehicle, where one country made pistol, one magazine and four live cartridges were recovered from possession of this petitioner.
5. It is submitted by learned counsel appearing on
Patna High Court CR. MISC. No.57317 of 2025(4) dt.27-11-2025 2/3 behalf of the petitioner that petitioner has been falsely implicated in the present case. It is submitted that no arms appears to be recovered from conscious physical possession of this petitioner. It is submitted that petitioner is a student of Post Graduate course in Political Science in Patna University.
6. While concluding argument, it is submitted that investigation of this case is already concluded, for which charge-sheet has been submitted and as such, there is no chance of tampering with the evidence.
7. Learned A.P.P. for the State has opposed the prayer for bail of the petitioner.
8. Considering the nature of accusation, and also as prima facie recovery of alleged arms not appears to be made from conscious physical possession of this petitioner, coupled with the fact that petitioner remains in custody since 1.05.2025, where investigation of this case is already completed, accordingly, above-named petitioner is directed to be released on bail, furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Patna
