Petitioner seeks bail in a case registered under section 47(A) of the Excise Act.

In huge quantity Indian made foreign liquor were recovered from a shop and owner of the aforesaid shop, namely, Kapileshwar Rai was arrested on the spot. Subsequently, police submitted prosecution report showing the petitioner as owner of the said shop. However, it is informed that the petitioner had given the aforesaid shop on rent to Kapileshwar Rai.

Moreover, petitioner is in jail custody since 30.8.2016 and prior to the present case, only one case i.e. under the Children Marriage Restraint Act, 1929 had been registered against him. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on
