SINGH ORAL ORDER 08-04-2025 In pursuance to the direction of this Court, both the petitioner as well as informant/O.P No. 2 have appeared in person along with their respective counsel. It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against all the F.I.R named accused persons including the petitioner. The informant is a quarrelsome lady and has made his life miserable. The petitioner made all his efforts to continue his matrimonial obligation with the informant but all his efforts went in vein. Ultimately, the petitioner has filed Divorce Case No. 334 of 2022 under

Patna High Court CR. MISC. No.61133 of 2024(6) dt.08-04-2025 2/3 Section 13 of the Hindu Marriage Act for dissolution of marriage and thereafter the informant has registered the present F.I.R in order to make pressure upon the petitioner. Learned counsel further submits that informant/O.P. No. 2 has also filed a case for maintenance in which interim order has been passed regarding payment of Rs. 2500/- per month as maintenance in favour of the informant/O.P. No. 2. It is submitted by learned counsel for the informant that informant married with the petitioner on 07.12.2020 as per Hindu Rites and Rituals. After marriage, the in-laws family members including the petitioner started demanding Rs. 10 lakh as dowry and when the informant refused to ask for money from her parents, she was assaulted and ousted from her matrimonial house.

The informant, though admits that she has filed a maintenance case in which an interim order was passed regarding payment of Rs. 2500/- per month in favour of the informant. It appears that matter was placed before the Mediation Center for an amicable settlement.

The petitioner is ready to pay Rs. 2500/- per month to the informant/O.P. No. 2 in pursuance to the direction in the maintenance case filed on behalf of the informant.

Considering the aforesaid facts, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail, on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Bhojpur at Ara in connection with Mahila P.S. Case No. 102 of 2022. The bail bonds of the petitioner will be accepted on filing receipt of up-to-date payment of Rs. 2500/- to the informant as maintenance which was granted in a maintenance case filed on behalf of the informant.
