The petitioners are apprehending their arrest in Katra P.S. Case No.65 of 2016 for the offences under Sections 147, 148, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. Accusation is that when the informant Sacchidanand Singh made demand of money of grass which was due against Dinesh Sahni who refused to give his money and also abused him. There was Panchayati held on 15.08.2016 in which Dinesh Sahni was held guilty. Then co-accused Umesh Sahni told to kill the informant upon which Umesh Sahni, Mahesh Sahni(petitioner no.1), Eklabya Sahni, Devraj Sahni, Bipin Sahni, Raja Sahni (petitioner no.2) assaulted the informant by knife, lathi, danda

Patna High Court Cr.Misc. No.17815 of 2017 (3) dt.08-08-2017 2/2 and rod causing injury on his head and also snatched gold chain of the informant.

Learned counsel appearing on behalf of the informant submits that the occurrence of mar pit took place on account of dispute in between the informant and the petitioners. Moreover, three injuries found on the person of the informant which are said to be caused by knife, danda, rod, are of simple in nature. The petitioners have no criminal antecedent. There is no report about the nature of the injury.

Having considered the facts and circumstances of the case, let the petitioners, in the event of their arrest or surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs.10,000/- each with two sureties of the like amount each to the satisfaction of the Sri Sukun Kumar Manjhi, J.M., 1st Class, Muzaffarpur, in Katra P.S.Case No.65 of 2016 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
