The petitioner seeks bail in Mehus P.S. Case No.03/2015 registered under Sections 147, 148, 149, 341, 323, 307 and 506 of the Indian Penal Code and subsequently Section 302 I.P.C. was also added.
The prosecution case, in short, is that on 13.3.2015 the informant was running his shop and at the same time the brother of the informant was going to Barbigha market from his house. It is alleged that all accused persons variously armed assaulted the informant's brother, as a result of which he became unconscious and after that he was hospitalized in referral hospital, Barbigha. It is submitted on behalf of the petitioner that the
Patna High Court Cr.Misc. No.41333 of 2015 (3) dt.30-10-2015 petitioner has got no criminal antecedent. He is in custody since 16.5.2015. The charge sheet has been submitted in this case. There is no allegation of tampering with the evidence against the petitioner. There is a case and counter case. Counter case is Annexure-2 to the present application for bail. General and omnibus allegation has been made against the petitioner and no specific injury has been attributed against the petitioner. On behalf of the State, it has been submitted that the petitioner is named in the first information report. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura in connection with Mehus P.S. Case No.03/2015.
