JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 08-11-2016 Heard the counsel for the petitioner and the State. The petitioner prays for regular bail in Karjain P.S. Case No. 42 of 2016 registered under diverse penal provisions of the Arms Act.

In substance, the allegation is that three miscreants riding on motorcycle was stopped by police party and search was carried out. From their possession, a loaded country made pistol, two live cartridges and a mobile set were recovered. The petitioner is one of them.

It is stated that the petitioner was taken into custody by the police on 12.05.2016 and on 17.05.2016, he was remanded to judicial custody. Two other accuseds persons of this case namely, Satyam Kumar and Himanshu Kumar @ Bittu have been granted bail by a co-ordinate Bench of this Court.

No.47694 of 2016 (2) dt.08-11-2016 2/2 Considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Shri A.K. Pandey, learned Judicial Magistrate, Birpur (Supaul) in Karjain P.S. Case No. 42 of 2016 subject to the condition that one of the bailors shall be his own/close family member. The petitioner shall appear in person on each date fixed at the trial. In case of default in appearance on two consecutive dates, the trial court shall have liberty to cancel his bail bonds.
