The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 304-B, 201 and 34 of the Indian Penal Code pending in the learned court below.
Allegation against the petitioner is that he along with others co-accused persons killed the daughter of the informant. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that petitioner is the husband of the deceased. He further submits that petitioner was not present on the date of occurrence. He submits that petitioner was residing out of the State. He submits that there is no specific overt act against the
Patna High Court CR. MISC. No.64448 of 2022(2) dt.16-01-2023 2/2 petitioner. He further submits that petitioner have got no criminal antecedent as stated in para-3 of the bail application. Per contra, learned APP for the State vehemently opposing the bail application and submitted that the allegation levelled as the petitioner is serious in nature. Hence, he does not deserve anticipatory bail.
Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Singhwalia P.S. Case No. 369/2021. Accordingly, his prayer for anticipatory bail is hereby rejected. (Anjani Kumar Sharan, J) ajay/- U T
