JUSTICE BIBEK CHAUDHURI ORAL ORDER 01-10-2024 A short question is involved in the instant writ petition on the issue of granting compassionate appointment in favour of the petitioner. One Satrudhan Singh was an employee of the Minor Irrigation Division, Samastipur. He died in harness on 10th October 2017. After the death of the said Satrudhan Singh, the petitioner, being his son, had obtained Income Certificate, Caste Certificate, Resident Certificate, Character Certificate, Unemployment Certificate, etc. and thereafter, filed an application for compassionate appointment. The said application was

Patna High Court CWJC No.14860 of 2024(2) dt.01-10-2024 2/2 supported by the widow of Satrudhan Singh, stating, inter alia, that she had no objection if the petitioner gets employment. However, the petitioner's employment has not been considered as yet, on the ground that the name of the father of the petitioner was recorded in the School Leaving Certificate as Satto Singh, and there is no document filed by the petitioner to show that Satto singh and Satrudhan Singh was the same and identical person. It is not disputed that after the death of the father of the petitioner, his widow got the retirement benefit and family pension. The said widow of the deceased employee has filed an affidavit that the petitioner is the son born in the wedlock between her and the Satrudhan Singh. The local panchayat member submitted a certificate that Satrudhan Singh was also known as Satto Singh during his lifetime.

2. In view of such circumstances, the District Compassionate Appointment Committee, Samastipur, is directed to consider the issue in light of the observation made hereinabove.

3. With the above direction, the instant writ petition is disposed of.
