2. The petitioner has preferred this application for grant of regular bail in connection with Piribazar P.S. Case No. 08/2025 dated 14.01.2025 registered for the offence punishable u/s 126(2), 115(2), 318(4) read with Section 3(5) of the B.N.S.
3. As per the prosecution case, the allegation against the petitioner is committing fraud with the informant on the name of selling two katha land to the informant. The informant also paid Rs. 4 lacs to the petitioner but later on the informant found that the said land did not belong to him. So, in this way neither he executed the sale-deed nor he returned the total money.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner. It is a case of civil nature. Learned counsel has submitted that the petitioner has returned Rs. 1,28,000/- to the informant and he has no intention to grab the amount of the informant. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 18.05.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that till date the petitioner has returned only Rs. 1,28,000/- to the informant.

Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Lakhisarai in connection with Piribazar P.S. Case No. 08/2025, with the condition ;- (i). The petitioner is directed to remain physically present before the learned Court below on each and every date,
Patna High Court CR. MISC. No.57038 of 2025(2) dt.20-08-2025 3/3 failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled.
