The petitioners apprehend their arrest in connection with Kurtha P.S. Case No. 101 of 2016, registered under Sections 147, 148, 149, 323, 324, 325, 307, 354, 379, 448, 427, 504 and 506 of the Indian Penal Code and Section 27 of the Arms Act. The accusation is that eight persons named in the F.I.R. including the petitioners came at the Boring of the informant and started to damage the boring. When the informant made protest then accused persons started to abuse. At that time, petitioner no. 1 caused injury at the right palm of the informant through Garasa whereas co-accused Ram Babu Singh caused
Patna High Court Cr.Misc. No.16431 of 2017 (3) dt.13-07-2017 fracture injury at his elbow through iron rod and petitioner no. 2 caused injury to at his back and leg through lathi. Learned counsel for the petitioner submits that petitioners and the informant are agnates and due to land dispute the present case has been lodged with false allegation. Having regard to the facts and circumstances of the case, let the above named petitioners be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Arwa, in connection with Kurtha P.S. Case No. 101 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
