The petitioner apprehends his arrest in connection with Ishakchak (Tilkamanjhi) P.S. Case No. 105 of 2016, registered under Sections 406, 420, 419, 467, 468, 471 and 120-B/34 of the Indian Penal Code.
The accusation is that complainant, Rajesh Mishra, used to run consultancy in the name of P.R.M Education Pvt. Ltd. at Bhagalpur. In that course, he came in touch with Vipul Kumar, Director consultancy, D2-C, D-Block, Lane-1, Aman Vihar Sahastradhara Road, Dehradun, Uttrakhand, Dr. Kuldeep, Principal, Core Engineering College, Rurki, Haridwar, Utrakhand, Kumar Gaurav, Director, Asha Academy, Opposite B.Ed. College, Core Engineer College Rurki, NH 58, Rurki Haridwar Highway, Utrakhand and Nelam Soni, Lecturer-cum-Incharge Principal,
Patna High Court CR. MISC. No.54442 of 2019(3) dt.16-11-2019 2/2 Core Engineer College, Rurki, Uttrakhand and talk about admission of 74 students for B.Ed. Course and Rs.42,30,000/- was given to them, out of which, cash of Rs.3,74,000/- was given to Vipul Kumar but only 20 students were allowed to appear in the examination. As such, all accused persons committed mischeaf with the complainant. Learned counsel for the petitioner submits that admittedly, petitioner is the Principal of Core Engineering College, Rurki, Haridwar, Utrakhand, under which, B.Ed. Course is also available and this petitioner never met with the complainant, perhaps he met to Vipul Kumar who is running the consultancy at Dehradoon to get admission of the students in different course and not a single penny was handed over to him by the complainant.
It is further submitted that co-accused, Vipul Kumar, has already been granted privilege of pre-arrest bail by this Court vide order dated 09.05.2019 passed in Criminal Misc. No. 13681 of 2019. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Bhagalpur, in connection with Ishakchak (Tilkamanjhi) P.S. Case No. 105 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
