The petitioner apprehends her arrest in Chhatauni P.S. case No. 26 of 2017 for the offences punishable under Section 366A of the Indian Penal Code.

The informant alleged that his daughter was missing. The informant further alleged that his daughter left her house to participate in Sarswati Puja organized in the school in which she was teacher. Arbind Prasad Yadav @ Guddu Jee came and took out all the educational certificates of his daughter but later on it transpired that his daughter and Arbind Prasad Yadav @ Guddu Jee were missing.

The learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.34776 of 2017 (3) dt.10-08-2017 2/2 petitioner is wife of Arbind Prasad Yadav @ Guddu Jee. The victim made her statement under Section 164 of the Cr. P. C. but she did not make any allegation against the petitioner. She simply alleged that petitioner was also present in a school where Arbind Prasad Yadav @ Guddu Jee took her. The victim made allegation against Arbind Prasad Yadav @ Guddu Jee.

Considering the facts aforesaid and the nature of allegation made against the petitioner and the fact that petitioner is a lady, the petitioner above named in the event of her arrest or surrender before the learned court below within a period of four weeks from the date of receipt/ production of a copy of this order is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Chhatauni P.S. case No.26 of 2017, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
