2. The petitioner is in custody since 29.07.2015 in connection with Sursand P.S. Case No. 34 of 2015 for the offences alleged under Sections 384 and 387 of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated merely because he happens to be a co-villager of the informant. There is no material such as C.D.R. of mobile call to support the accusation of demand for ransom. The accusation of ransom call made on the Munshi's mobile phone is highly improbable. The petitioner is on bail in most of the cases in which he is accused.
4. Having regard to the entirety of the facts and circumstances of the case and the period of custody already suffered, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Sri P.K. Lal, learned Judicial Magistrate, 1st Class, Pupri at Sitamarhi in connection with Sursand P.S. Case No. 34 of 2015
Patna High Court Cr.Misc. No.48092 of 2016 (3) dt.13-12-2016 2/2 with the following conditions:
(i) That one of the bailors shall be a close relative of the petitioner.
(ii) That the petitioner shall not indulge in any similar offence till conclusion of the trial. (iii) That the petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, his bail bond shall be liable to be cancelled by the learned Court concerned.
