The petitioner is in custody in connection with Sour Bazar (Patarghat O.P.) P.S. Case No. 108 of 2019 for the offences under Sections 25(1-a), 25(1-AA), 25(1-B), 26 and 35 of the Arms Act.

Learned counsel for the petitioner would submits that the petitioner has got no criminal antecedent. The allegation against the petitioner is that during the search Katta (country made pistol) has been recovered from the conscious possession of the petitioner.

The petitioner is in custody since 30.03.2019. Considering the fact that the petitioner has got no criminal antecedent and he has remained in custody for five
