JUSTICE BIRENDRA KUMAR ORAL ORDER 17-01-2017 Heard learned counsel for the petitioners, learned counsel for the informant and learned Additional Public Prosecutor for the State.

The Petitioners are apprehending their arrest in connection with Chapra Town Police Station Case No.410 of 2016 registered for the offence punishable under Section 302/34 of the Indian Penal Code.

The petitioners and others allegedly assaulted with knife causing death of Raj Kumar Pandey, the doctor has found fifteen incised wound on the person of the injured.

Submission of the petitioners is that there is no specific allegation as to at which part of the body of the deceased the

Patna High Court Cr.Misc. No.49765 of 2016 (3) dt.17-01-2017 2/2 petitioners had caused injury. He further submits that for land dispute the allegation is there.

Considering the nature and seriousness of the allegation, I am not inclined to grant anticipatory bail to the petitioners in connection with Chapra Police Station Case No. 410 of 2016 pending in the Court of learned Chief Judicial Magistrate, Saran at Chapra/Successor Court. Accordingly, the prayer for anticipatory bail is rejected.
