The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 324, 384, 307 of the Indian Penal Code and Section 27 of the Arms Act. Petitioner is said to have fired upon the informant which hit him on the right thigh.

Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He submits that there is specific allegation of firing against co-accused Gulshan Kumar. He submits that the petitioner was not present at the time of occurrence and he has no concerned with co-accused Gulshan Kumar. He further submits that petitioner has no criminal antecedent as stated in para-3 of this application.

Patna High Court CR. MISC. No.67366 of 2022(2) dt.25-02-2023 2/2 Learned APP for the State opposes the prayer for bail and submits that the petitioner was also involved in the present case.

Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for anticipatory bail is rejected in connection with Barauni (FCI) P.S. Case No. 337 of 2021 pending before the court of the learned Judicial Magistrate-1st Begusarai. (Anjani Kumar Sharan, J) Trivedi/- U T
