2. The petitioner seeks bail in a case registered for offence under Sections 147, 149, 323, 341, 342, 448, 307, 354, 354(B), 379, 504, 506 of the Indian Penal Code.
3. As per prosecution case, on 19.05.2023 at about 6 AM, the wife of the petitioner took away bucket, which was kept at the gate of informant. It is further alleged that this petitioner abused and assaulted wife of informant on her head by iron rod and thereafter, other co-accused persons also assaulted informant and his other family members.
4. Learned counsel for the petitioner submits that petitioner and informant are Gotiyas and due to partition dispute, Maarpeet took place between the parties. Present case is
Patna High Court CR. MISC. No.62223 of 2024(2) dt.06-12-2024 2/2 counter blast of Anti P.S. Case No. 41 of 2023, lodged against the informant by co-accused Vinod Yadav, who has already been granted bail by a coordinate Bench of this Court, vide order dated 18.10.2023 passed in Cr.Misc. No. 68386 of 2023 (Annexure P/5). Petitioner has got clean antecedent and is in custody since 25.05.2024. Chargesheet has been submitted.
5. Learned A.P.P. for the State vehemently opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Gaya in connection with Anti P.S.
