2. Petitioner apprehends arrest in a case registered for the offence punishable under section 126 ( 2 ), 115 ( 2 ), 121

(1) , 121 ( 2 ), 132, 109, 352, 351 and 3(5) of BNS. 3 . As per the prosecution case , informant namely Md. Arman Khan ( Mines Inspector ) alleged that he along with Asst. Engineer, Junior Engineer and other police officials seized one Mahindra 265 DI tractor bearing Registration No. BR-38G8605 loaded with 100 CFT dusty soil and in course of bringing seized tractor from Rampur PVC Branch canal at 9:30 AM, one person on a super splendor motorcycle along with 70 to 80 unknown miscreants attacked police party and got released the

Patna High Court CR. MISC. No.60420 of 2025(2) dt.08-09-2025 2/2 seized tractor from police custody .

Considering the fact that accused persons attacked on police party due to which some police personnel sustained injuries and they also became successful in releasing the seized tractor from police custody and other circumstances of the case , prayer for pre-arrest bail of the petitioner is rejected.
