Patna High Court CWJC No.18122 of 2016 (2) dt.07-03-2017 The grievance of the petitioners is that their lands were acquired treating as agricultural land though the nature of acquired land was of residential but the respondents are not ready to treat their acquired land as residential land.

Learned counsel for the petitioners submits that petitioners filed the representation before the District Land Acquisition Officer, Patna which is annexed to this writ petition as Annexure-7 but the same has not been disposed of as yet. The aforesaid issue is a disputed fact which cannot be decided in this writ petition and it is the District Land Acquisition Officer, Patna who is competent authority to decide the aforesaid issue and, therefore, this writ petition stands disposed of giving direction to the District Land Acquisition Officer, Patna to dispose of the representation filed on behalf of the petitioners within six weeks from the date of receipt / production of a copy of the order.
