Since there is similarity in the facts of the present case and the circumstances under which the Examination Committee vested with the powers of conducting the examination for Advocate on Record are similar, therefore, the decisions so taken by the Examination Committee dated 07.08.2017 of the Patna High Court can be extended even to the present petitioner because even in her case she has qualified in the three papers with aggregate of 60% and only in one paper she has failed to notch up a minimum of 40% marks.
The appeal is allowed. The petitioner is permitted to participate in the ensuing examination, which is scheduled to be
Patna High Court LPA No.2072 of 2016(10) dt.30-11-2017 2/2 held sometime in the month of December in the 4th paper alone in which she has failed to get the minimum qualifying marks. Appeal stands disposed off in terms of the above. (Ajay Kumar Tripathi, J) ( Rajeev Ranjan Prasad, J) Pawan/- U
