2. The petitioner is in custody since 13.07.2023 in connection with Rajpur P.S. Case No. 272 of 2023 registered for the offence punishable under Sections 376/504/506 of the Indian Penal Code and Section 4 and 6 of the POCSO Act.
3. As per the prosecution case, the petitioner being a teacher has ravished the chastity of a 16 year old girl who was his student.
4. Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. The petitioner is a renowned teacher who runs his coaching centre which has a
Patna High Court CR. MISC. No. 59667 of 2023(3) dt.08-11-2023 2/2 large number of girls students. He next submits that this false has been lodged against the petitioner only to malign his image. The petitioner has no criminal antecedents.
5. Learned Additional Public Prosecutor appearing on behalf of the State has vehemently opposed the prayer for bail. He has submitted that the girl is of 16 years of age.
6. Considering the facts and circumstances of the case and also the gravity of allegations levelled against the petitioner, I am not inclined to grant him bail. It is, accordingly, dismissed.
7. The trial of the case is directed to be expedited. (Sandeep Kumar, J) Saif/- U T
