JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-05-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under section 47(a) of the Excise Act.

2200 liters of country made liquor were recovered from the place owned by the petitioner.

It is submitted by the learned counsel for the petitioner that the recovery cannot be treated from the possession of the petitioner and Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. The aforesaid facts constitute grounds for consideration of the prayer for regular bail of the petitioner by the learned court

Patna High Court Cr.Misc. No.17612 of 2015 (2) dt.18-05-2015 2/2 below in case the petitioners surrender within six weeks from today in connection with Excise Case No. 13 of 2012 pending in the court of learned JM Ist Class, Motihari, East Champaran. This application is disposed of with the aforesaid observation/direction.
