The petitioners are apprehending arrest in a case registered for the offences punishable under sections 341, 342, 323, 353, 427, 504, 506 and 34 of the Indian Penal Code. The prosecution case is that the petitioners entered into the class room and assaulted the children when informant being headmaster of the school made protest then he was assaulted by them.
It is submitted by learned counsel for the petitioners that the petitioners have no criminal antecedent, a statement to that effect has been made in paragraph 3 of the petition. Moreover, the informant has retracted from initial version and has filed a petition to that effect before the learned court below, the
Patna High Court Cr.Misc. No.42986 of 2015 (2) dt.14-10-2015 2/2 same has been brought on record as annexure-2 to the petition. The aforesaid facts constitute ground for consideration of prayer for regular bail. Let the learned Court below consider the prayer for regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Narayanpur P.S. Case No.49 of 2015, pending before the learned CJM, Bhojpur at Ara.
With the above observation, this application is, accordingly, disposed off.
